Building Strategies Tailored to Your Needs
At Rodriguez Lagorio, LLP, we understand how difficult it is to face an uncertain future. The legal world is complex. It can be challenging to be aware of every aspect of your case without the assistance of a lawyer. Emotional upheaval or confusion regarding how to proceed can cloud decision-making in family law matters, estate planning, and probate cases. Without proper guidance, you may make poor decisions about significant issues and compromise your best interests.
That’s what sets Rodriguez Lagorio, LLP, apart.
Our family is dedicated to ensuring you have the information and counsel necessary to make the best possible choices. Our goal is to make the quality service of a boutique law firm available to every family.
What does that service entail?
We take the time to listen to your concerns and ensure you understand your options. We also help you anticipate the consequences and possible outcomes when choosing your course of action. When you work with our skilled Fremont family law and estate planning attorneys, we will guide you every step of the way as you proceed through resolving your issue.
Proactive Advice and Counsel for Your Family’s Needs
Our energetic Bay Area attorneys offer knowledgeable legal services for family law, estate planning, revocable trusts, trust administration, and probate. These areas of the law often overlap.
For example, updating your estate plan after a divorce is essential. This will ensure that your former spouse is no longer the personal representative named in your will or named as the agent for your power of attorney documents, or the beneficiary of your life insurance policy. If you do not have an estate plan, now is the time to establish one, especially if you have children or own a business.
Our Fremont family law and estate planning attorneys draw from in-depth experience to protect your rights, whether you are facing a divorce or separation, dividing complicated marital property, establishing custody and support for your children, or dealing with the death of a loved one. Because California courts lean toward seeking amicable solutions through negotiation and mediation, we can also assist you in approaching a tough conflict with alternative dispute resolution methods such as mediation.

Angelo was helpful and clear helping us maneuver the prenup journey. Thanks, Angelo! Ralph GarnerTrustindex verifies that the original source of the review is Google. I can't say enough good things about our decision to hire attorney Angelo J. Lagorio. I was in need of an uncontested legal separation. I knew I needed an attorney. I shopped around, interviewed a couple attorneys, and, in my opinion, they were all too expensive (by thousands of dollars) for a simple uncontested separation. They all said "this is our starting price, but expect additional costs." To me that meant lots more money down the road. I didn't want my attorney to basically have a blank check for an uncontested legal separation. I found Angelo online and he contacted me almost immediately. I liked him right away - he said he'd do it for a very reasonable flat rate. Music to my ears! And he delivered. He responded to texts and emails promptly. He stayed in touch as we progressed along, keeping me updated with our progress. I never had to go to his office, everything done via email, text, or phone. All the legal documents were signed and necessary PDF files were signed via email. His software packages were smooth running and easy to use. If 5 Stars is the highest Angelo J. Lagorio is 6 Stars. Even my soon-to-be x-wife thought he was good. Ralph Garner Brentwood CA Audrey GTrustindex verifies that the original source of the review is Google. Angelo is amazing!! He went above and beyond to help me through a difficult time in my life. He was available by email and phone that allowed for flexibility. Angelo’s legal expertise is concise and accurate. He respects your time and money. Angelo came with high recommendations from two colleagues and I’m very thankful to receive the same results. Don’t waste your time on other Family Law Attorneys, he’s the BEST! t campbellTrustindex verifies that the original source of the review is Google. I was in bad situation in my marriage, and left. The next step was divorce. I contacted Angelo and he streamlined the entire process for me. He took care of everything after I filled out the forms. And before I knew it, the divorce was final. I highly recommend Angelo, he is helpful, answers every question, and makes what seems like a daunting process, simple. So grateful for his help throughout this bittersweet time. D CTrustindex verifies that the original source of the review is Google. When my separation began, I quickly made a decision to seek out advice of a family law attorney. After a number of consultations with attorneys, I had one more with Angelo Lagorio. I was quickly impressed by Angelo’s confidence, clarity of his advice, directness of his inputs and simplicity of his strategy. I walked away from that consult with an understanding of the process that I didn’t get from other attorneys with whom I talked. I had one more consult scheduled and decided to cancel that, knowing that Angelo was the right person to represent me and to take on my case. Angelo encouraged me to take time away that I had plans to enjoy. I did that. During that time, I was being constantly engaged by my spouse. I contacted Angelo, to engage his services. He again gave me direct feedback to detach from my spouse and to find a way to enjoy the time away. That was sound advice. Over the next two years and 5 months, Angelo kept me as even keeled as I could be. During the entire time, my spouse and her attorney introduced complexities, resulting in added legal fees and time delays. Angelo stayed the course of the strategy we had discussed in the consult. He effectively managed the complexities the opposing counsel and his client threw at us. The legal fees were not insignificant to me, given that I am disabled and no longer able to work. However, Angelo successfully ensured that I received property and financial settlements that I was due. Overall his upfront fee estimate was within an acceptable range and actual expenses were close to estimate. He told me up front of things that could cause that overall cost to vary. His billing was always representative of work he actually preformed. I was never surprised by a bill. Furthermore, his choice of a forensic CPA was perfect. That expert helped to untangle commingled marital expenses, both pre and post separation. Overall I am grateful for Angelo I am completely satisfied by my decision to select him and with the outcome he achieved. Brook SchultzeTrustindex verifies that the original source of the review is Google. Angelo was extremely helpful and clear for each step I needed to take. He was great at communication and always got back to me very quickly as well. With such an overwhelming process he helped put a lot at ease with all his knowledge and advice.

FAQs
How is child custody determined in California?
When parents ask a judge to determine child custody arrangements for them, the judge would seek an arrangement that is in the child’s best interests. They would consider factors like parental capacity, the child’s emotional ties to each parent, any history of abuse, and the child’s health, safety, and welfare. While courts often favor frequent, continuing contact with both parents, this arrangement is not automatic or always preferable.
How is property normally divided in a California divorce?
California’s community property laws mean marital property is normally divided according to a 50/50 split in a divorce. This split would include all assets and debts acquired during the marriage, such as money in bank accounts, homes, cars, and other property. Separate assets that have become commingled in the same bank account may also be treated as community property.
Do parents who are separated legally have to pay child support in California?
Yes, parents who are legally separated are still responsible for supporting their children financially, and the court may order them to pay child support. California law requires both parents to provide financial support for the child regardless of whether they are married, divorced, or separated. A judge can issue a court order that compels the noncustodial parent to provide a specific amount of support based on their net disposable income, the number of children, and the amount of time they spend with the child.
When is the right time to start estate planning?
It is never too early to start estate planning, but this process is especially recommended around the same time as major life events, such as turning 18, getting married or divorced, purchasing a home, or starting a family. It is also important to review your estate plans every few years with an attorney to ensure that they continually reflect your wishes.
What estate planning documents should you have?
A comprehensive estate plan may include a range of documents, such as a will, a living trust, a durable power of attorney, an advance healthcare directive, and beneficiary designations. Our attorneys will discuss your estate planning goals, preferences, priorities, and wishes, then walk you through drafting all necessary documents to achieve those goals.
Can you bypass probate by creating a will?
While creating a will alone would not allow your beneficiaries to bypass probate after your death, certain estate planning measures could accomplish this goal. For example, placing your assets in a revocable living trust could automatically transfer them to the beneficiary, avoiding probate. Our attorneys can help you explore this and other strategies to facilitate a smooth transfer of assets and minimize the stress on your family after you pass away.
