How is child custody determined in California?

When parents ask a judge to determine child custody arrangements for them, the judge would seek an arrangement that is in the child’s best interests. They would consider factors like parental capacity, the child’s emotional ties to each parent, any history of abuse, and the child’s health, safety, and welfare. While courts often favor frequent, continuing contact with both parents, this arrangement is not automatic or always preferable. 

California’s community property laws mean marital property is normally divided according to a 50/50 split in a divorce. This split would include all assets and debts acquired during the marriage, such as money in bank accounts, homes, cars, and other property. Separate assets that have become commingled in the same bank account may also be treated as community property. 

Yes, parents who are legally separated are still responsible for supporting their children financially, and the court may order them to pay child support. California law requires both parents to provide financial support for the child regardless of whether they are married, divorced, or separated. A judge can issue a court order that compels the noncustodial parent to provide a specific amount of support based on their net disposable income, the number of children, and the amount of time they spend with the child.   

When is the right time to start estate planning?

It is never too early to start estate planning, but this process is especially recommended around the same time as major life events, such as turning 18, getting married or divorced, purchasing a home, or starting a family. It is also important to review your estate plans every few years with an attorney to ensure that they continually reflect your wishes.
